TERMS OF SERVICE

Last updated: 26 September 2026

OVERVIEW

This website and online store are operated by Left Wright Collective, based in Calgary, Alberta, Canada. Throughout these Terms of Service, “we,” “us”, and “our” refer to Left Wright Collective.

These Terms of Service govern your access to and use of our website, online store, products, content and related services (collectively, the “Services”).

By visiting our website, creating an account or placing an order, you agree to these Terms of Service and our policies, including our Privacy Policy, Return and Refund Policy and Shipping Policy. If you do not agree, you must not use the Services.

Nothing in these Terms excludes, restricts or modifies any consumer right or remedy that cannot legally be excluded, including rights under applicable Canadian consumer-protection laws, the Australian Consumer Law and the mandatory laws of other destinations where we sell.

1. ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your province, state or country of residence, or have the permission and supervision of a parent or legal guardian, to use the Services or place an order.

You agree to provide accurate, complete and current account, contact, billing, payment and shipping information.

You are responsible for maintaining the confidentiality of your account and for activity conducted through it. Please contact us promptly if you believe your account has been accessed without authorisation.

We may suspend or close an account where reasonably necessary to prevent fraud, unlawful activity, security risks or material breaches of these Terms.

2. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, specifications, colours, measurements and images accurately. Colours and appearance may vary depending on your screen, device settings, lighting and manufacturing variations.

Product dimensions and measurements may be approximate unless expressly stated otherwise.

We may update product information, availability or pricing and may discontinue products. These changes will not affect an order that we have already accepted, except where required to correct an obvious error or comply with applicable law.

Any variation in appearance does not exclude your rights if a product is faulty, unsafe, materially different from its description or otherwise fails to meet an applicable consumer guarantee.

3. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase the selected products. An automated order acknowledgement does not necessarily mean that we have accepted the order.

We may decline or cancel an order for legitimate reasons, including:

  • Product unavailability
  • An obvious pricing or product-description error
  • Suspected fraud or unauthorised payment
  • Delivery restrictions
  • A violation of these Terms
  • A legal or regulatory requirement

If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method.

Please review your order carefully before submitting it. Orders are transmitted to our fulfilment provider automatically, so changes and cancellations are not guaranteed after processing begins. Our Return and Refund Policy explains the applicable cancellation and return process.

Products are intended for personal or household use unless we agree otherwise in writing. You must not purchase products for unauthorised resale.

4. PRICES, CURRENCY AND PAYMENT

Prices are displayed in the currency selected or assigned for your market. Currency conversions may use a current exchange rate and rounding rules, so converted prices may change.

The price payable is the price displayed at checkout when your order is submitted, subject to correction of an obvious error.

Shipping charges, discounts, taxes, duties and other applicable charges will be displayed at checkout when Shopify can calculate them. Import duties, taxes or carrier charges that cannot be calculated at checkout may be payable separately by the recipient.

You authorise us and our payment providers to charge the payment method selected at checkout. You represent that you are authorised to use that payment method and that the payment information supplied is accurate.

Promotions may be subject to additional conditions. If promotional terms conflict with these Terms, the specific promotional terms apply to that promotion.

5. SHIPPING, DELIVERY AND FULFILMENT

Orders are fulfilled and shipped by third-party fulfilment providers, including Tradelle Fulfillment. Products may be dispatched from an international warehouse or supplier facility.

We currently offer shipping to Australia, Canada, the United States and New Zealand. Additional destinations may become available as our store expands. The destinations and delivery options currently available are those shown at checkout.

Delivery dates are estimates and are not guaranteed. Customs processing, carrier disruptions, weather, peak periods and other events outside our reasonable control may affect delivery.

We remain responsible for addressing delivery problems to the extent required by applicable law. Risk of loss passes to you when the order is delivered to you or a person authorised to receive it, except where applicable law provides otherwise.

Please review our Shipping Policy for information about destinations, rates, estimated delivery times, tracking, customs charges, incorrect addresses and delayed or lost parcels.

6. RETURNS, REFUNDS AND CANCELLATIONS

Returns, replacements, refunds and cancellations are handled under our Return and Refund Policy.

Our voluntary change-of-mind policy is separate from, and does not replace, any statutory rights concerning faulty, unsafe, incorrectly described or incorrectly supplied products.

Where applicable consumer law gives you a remedy, these Terms and our policies do not remove or reduce that remedy.

7. CONSUMER GUARANTEES

Products may come with rights and guarantees that cannot legally be excluded.

For Australian consumers, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Australian consumers may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage. They may also be entitled to a repair or replacement where goods are not of acceptable quality and the failure is not major.

Canadian customers may also have rights under applicable federal and provincial consumer-protection laws.

Customers in the United States, New Zealand and other destinations retain any mandatory rights provided by the laws applicable to their purchase.

8. INTELLECTUAL PROPERTY

The content available through the Services—including our branding, text, graphics, photographs, product presentation, videos, layout and design—is owned by or licensed to Left Wright Collective and is protected by applicable intellectual-property laws.

You may access and use the Services for lawful, personal and non-commercial purposes. You must not reproduce, distribute, modify, republish, sell or commercially exploit our content without prior written permission, except where permitted by law.

Shopify’s names, logos and related materials are owned by Shopify or its licensors. Other names and trademarks belong to their respective owners.

9. OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services may provide access to tools, applications, payment services, fulfilment services or other functionality supplied by third parties.

Your use of third-party services may also be governed by the provider’s terms and privacy policy. To the extent permitted by law, we are not responsible for third-party services that we do not control.

We may introduce or remove optional features and third-party tools from time to time.

10. THIRD-PARTY LINKS

Our website may contain links to websites operated by third parties. A link does not necessarily mean that we endorse or control that website.

Before purchasing from or providing information to a third party, you should review its terms and privacy practices. Questions or disputes about a transaction made directly with a third party should be directed to that third party.

Nothing in this section limits any responsibility we have for products purchased directly from Left Wright Collective.

11. RELATIONSHIP WITH SHOPIFY

Left Wright Collective is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Left Wright Collective.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Left Wright Collective, including injury, damage or loss resulting from purchased products and services. To the extent permitted by law, you release Shopify and its affiliates from claims arising from or related to purchases and transactions with Left Wright Collective.

12. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy:

https://leftwrightcollective.myshopify.com/policies/privacy-policy

Because Shopify hosts our store, Shopify processes certain personal information to provide and improve the Services. Information may also be shared with payment processors, fulfilment providers, delivery companies and other service providers required to complete your transaction.

Information may be processed in countries other than the country where you live, subject to applicable privacy requirements.

13. REVIEWS, FEEDBACK AND USER CONTENT

If you submit a product review, photograph, comment, suggestion or other content, you confirm that you own it or have permission to submit it.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that content for operating and promoting the Services, subject to applicable privacy law.

You must not submit content that is unlawful, misleading, defamatory, abusive, obscene, infringing, fraudulent or malicious.

We may moderate or remove content where reasonably necessary, but we are not required to publish or respond to every submission.

14. ERRORS AND INACCURACIES

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions.

We may correct an error and update information. If an obvious error materially affects an order already submitted, we will contact you and provide the option to confirm the corrected order or receive a refund.

Nothing in this section permits us to mislead customers or avoid obligations relating to an accepted order.

15. PROHIBITED USES

You must not use the Services:

  • For an unlawful, fraudulent or malicious purpose
  • To infringe another person’s rights
  • To transmit viruses, malware or harmful code
  • To obtain unauthorised access to an account or system
  • To collect another person’s information unlawfully
  • To send spam or misleading communications
  • To interfere with the security or operation of the Services
  • To scrape, reproduce or exploit the Services in violation of applicable law or our intellectual-property rights
  • To impersonate another person or misrepresent your identity
  • To circumvent measures used to prevent fraud, abuse or unauthorised automated access

We may restrict access where reasonably necessary to protect customers, our business, Shopify or our service providers.

16. SERVICE AVAILABILITY

We aim to keep the Services available and accurate, but we do not guarantee that the website will always be uninterrupted, secure or error-free.

The website may be temporarily unavailable because of maintenance, technical problems, security incidents or circumstances outside our reasonable control.

This section concerns operation of the website and does not exclude any legally required guarantee applying to the products we sell.

17. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising under applicable consumer-protection laws.

Subject to those mandatory rights, we are not responsible for loss caused solely by:

  • Your misuse of a product or the Services
  • Inaccurate information supplied by you
  • Unauthorised access resulting from your failure to protect account credentials
  • A third-party service or website that we do not control
  • An event outside our reasonable control

To the extent permitted by law, we are not liable for losses that were not reasonably foreseeable when the contract was formed.

These limitations do not apply to fraud, wilful misconduct or any other liability that applicable law prohibits us from limiting.

18. INDEMNITY

To the extent permitted by law, you agree to compensate Left Wright Collective for reasonable losses, liabilities and expenses directly caused by your unlawful use of the Services, infringement of another person’s rights or material breach of these Terms.

This section does not require you to compensate us for loss caused by our own acts, omissions, negligence or breach of law.

19. TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access where reasonably necessary because of unlawful activity, fraud, security risks or a material breach of these Terms.

Termination does not affect rights or obligations that arose before termination. Provisions that by their nature should continue—including provisions concerning intellectual property, liability, outstanding payments and dispute resolution—will survive.

20. SEVERABILITY AND WAIVER

If a provision of these Terms is found to be unlawful or unenforceable, it will be modified or severed only to the minimum extent necessary. The remaining provisions will continue to apply.

A delay or failure to enforce a right does not waive that right.

These Terms and the policies referenced in them form the agreement between you and Left Wright Collective concerning your use of the Services and purchases from our store.

21. ASSIGNMENT

You must not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a legitimate sale, restructuring or transfer of the business, provided the transfer does not reduce your existing consumer rights. We will provide notice where required by law.

22. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta.

This choice of law does not exclude any mandatory consumer protection available to you in Australia, Canada, the United States, New Zealand or another destination where we directly offer products.

You may bring a claim before any court, tribunal or consumer authority that has jurisdiction under applicable law.

Before commencing formal proceedings, we encourage you to contact us so we can attempt to resolve the matter.

23. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on our website and changing the “Last updated” date.

Material changes will apply from the effective date stated in the updated Terms and will not retroactively reduce rights relating to orders already accepted, unless required by law.
